Uncovered Medical Expenses

When insurance doesn’t cover a child’s medical expenses, parents must foot the bill. And depending on the parents’ medical insurance coverage, these expenses can either be simple co-pays or large hospital bills.

 This issue must be dealt with in all divorces.

 The district courts of appeal are very clear on this matter: The uncovered medical expense is to be divided based upon the percentage of the parties’ income.

 In other words if the husband earns 70 percent of the total income and the wife earns 30 percent, then the bills will be split in that manner. This is separate from any type of child support.

 A lot of parties agree to equally divide the uncovered medical expenses.  If you make less income than your spouse, you should insist on dividing these expenses by income percentages rather than equally.
